Personal data protection policy

Personal information. As such, they must be protected with the greatest care.

Privacy is a fundamental right and one of Justiscall's core values.

Justiscall undertakes to comply with French and European regulations on the protection of personal data, in particular the General Data Protection Regulation (EU) of April 27, 2016 (“RGPD”) and the Data Protection Act of January 6, 1978 Modifiee (“LIL”).

We work with the authorities in charge of data protection, at the European level and for each country where we are established, with the public actors responsible for the organization of the legal system, as well as with all the representatives of the customers, legal professionals, to ensure that we comply with all of our legal obligations with regard to the protection of personal data.

Justiscall has a team dedicated to the protection of personal data, including in particular a Data Protection Officer declared to the CNIL, a security team, a legal team and engineers specialized in data protection.

The personal data of customers who use Justiscall's services are hosted by a physical infrastructure host and outsourcer who has received certification.fication SSL

DEFINITIONS

The terms used in this Personal Data Protection Policy (hereinafter “Policy”) with capital letters have been defined.

PURPOSE OF THIS POLICY

Through this Policy, Justiscall informs Users of how Justiscall and Legal Actors process their Personal Data.

It applies to all Users of the Justiscall Platform.

 

ORIGIN OF PERSONAL DATA

Users are informed of the purposes for which their Personal Data is collected via (i) the information mentioned in the various online data collection forms; (ii) the Cookies Policy and (iii) this Personal Data Protection Policy.

  1. Personal Data collected from the User

All Personal Data concerning Users and/or their Relatives are collected from them by (i) Justiscall when creating their User Accounts or via the forms or other documents they complete as part of the use of the Services; or by (ii) Legal Actors, Justiscall Subscribers, when making appointments online and more generally in the context of any consultation or follow-up of the client.

  1. The Personal Data that Justiscall automatically collects when the use of the Services

Justiscall automatically collects, in particular by using Cookies, Personal Data during the Use by Users of the Services.

IDENTITY OF PROCESSING RESPONSIBLE

The data controller is, within the meaning of the GDPR, the person who determines the means and fitreatment features. Processor is a person processing personal data on behalf of the controller. He acts under the authority of the data controller and on his instructions.

 

Depending on the Personal Data processed, Justiscall may act as Data Controller or Processor on behalf of JUSTISCALL Actors.

Justiscall is Data controller Personal Data of Users collected as part of the creation and management of the User Account, their browsing on the Site and their use of the Justiscall Platform.

The Actors , Subscribers to the Services, are Managers  Personal Data collected as part of any consultation or follow-up of the Client. Justiscall then acts as a Subcontractor.

Whether it is a data controller or a subcontractor, Justiscall takes the appropriate measures to ensure the protection and confidentiality of the Personal Data it holds or processes in compliance with the provisions of the GDPR and national legislation.

PURPOSES AND PROCESSING OF PERSONAL DATA COLLECTED

  1. Necessity of collection

When using the Platform, the User communicates to Justiscall certain Personal Data necessary for the provision of the requested Service. If the User does not wish to provide the information requested of him, or opposes their use by Justiscall, the User may not be able to access certain parts of the Site or the Services and that Justiscall may be in the impossibility to respond to his request.

  1. Storage periods

All Personal Data collected is processed and stored for a limited period depending on the purpose of the processing and the legislation applicable to the Services.

Justiscall determines the retention periods for Personal Data solely in its capacity as Data Controller. In the context of the processing carried out as a Subcontractor, Justiscall acts solely on the instructions of the Data Controllers and does not itself determine the retention period of the Personal Data.

For any question or clarification on the retention period of Personal Data for which Justiscall is only a Processor, we recommend that you contact the data controller directly.

At the end of the storage periods, the Users' Personal Data are permanently deleted or anonymized.

Given the legal obligations of legal archiving, the data are likely to keep, on their own tools, the Personal Data of Users for a period of one year.

In the case of profiles created on behalf of Relatives, when the latter are attached to several User accounts, the deletion of a User account will not lead to the deletion of the Relative profile from the other User Accounts to which it is attached.

In order to guard against any unwanted deletion and related litigation, Justiscall may keep the deleted Document for seven (7) days from the deletion request.

After this period, the Document will be definitively deleted.

SUBCONTRACTORS AND RECIPIENTS OF PERSONAL DATA

THE USER'S PERSONAL DATA ARE NOT TRANSMITTED TO COMMERCIAL OR ADVERTISING ACTORS WITHOUT CONSENT

 

Internal use: The User's Personal Data may be processed by the employees of Justiscall SAS and its subsidiaries, within the limits of their respective attributions and this exclusively in order to achieve the purposes of this policy.

Justiscall also uses, for some activities related to its operation, the services provided by several specialized companies (mailing, audience analysis) the list of which can be communicated to the persons concerned on request sent to contact@Justiscall.com.

Accommodation: In order to comply with the GDPR concerning Personal Data, Justiscall uses Amazon Web Services as a Legal Data Host (HDS certified).

ALL LEGAL PERSONAL DATA ARE HOSTED WITHIN THE EUROPEAN UNION.

 

Cross-border transfer: In order to provide its Services, Justiscall may use service providers located outside the European Union. If the transfer takes place to a third country in which the legislation has not been recognized as offering an adequate level of protection for Personal Data, Justiscall ensures that the necessary measures are put in place in accordance with the Data Protection Act and Freedoms and GDPR.

USER RIGHTS

  1. Rights of Users over their Personal Data

In accordance with the European regulations in force, Users of Justiscall have the following rights:

  • Permission to access (article 15 GDPR) and rectification (article 16 GDPR), updating, completeness of Users' Personal Data: Users have the right to access the Personal Data concerning them held by Justiscall and request its rectification or update.
  • Right to erasure Personal Data of Users (Article 17 of the GDPR), when (i) they are no longer necessary, (ii) the User has withdrawn his consent, (iii) the User opposes the processing, (iv ) the processing is unlawful or to comply with a legal obligation. (find out more)
  • Right to withdraw consent at any time (article 13-2c GDPR) if this processing is based on consent.
  • Right to limitation the processing of Users' Personal Data (article 18 GDPR): This right means that the processing of Users' Personal Data which Justiscall may proceed is limited, so that the Personal Data is kept, but that Justiscall does not cannot use them or
  • Right of opposition to the processing of Users' Personal Data (Article 21 GDPR): Users may at any time object to the processing of their Personal Data when the processing is based on the legitimate interest of
  • Right to portability Personal Data that Users have provided, when this Personal Data is subject to automated processing based on their consent or on a contract (Article 20 GDPR). Users have the right to move, copy or transmit the Personal Data concerning them from the Justiscall database to a

  1. Modalities for exercising the rights of Users over their Personal Data:
  • For all requests concerning Personal Data for which Justiscall is Responsible.

If the User wishes to know how Justiscall uses his Personal Data, or to exercise his rights, the User can contact Justiscall by email at contact@Justiscall.com.

In this case, the User must indicate the Personal Data that he would like Justiscall to correct, update or delete, by identifying himself precisely with a copy of an identity document (identity card or passport) or any other element providing proof of identity.

  • For all requests concerning Personal Data for which Justiscall is Subcontracting :

If the User wishes to exercise his rights, he can contact the professional, Data Controller.

Justiscall, at the request of the professional, may assist the latter in the follow-up to be given to the requests sent by its Customers but cannot respond directly to the requests of the said Customers.

Requests for the deletion of Personal Data will be subject to the obligations imposed on Justiscall by law, in particular with regard to the conservation or archiving of documents.

By Decree No. 2021-1363 of October 20, 2021, the Prime Minister therefore enjoins electronic communications operators, "given the serious and current threat to national security", to retain the traffic and location data listed by the two other decrees of the same day for a period of one year. Decree No. 2021-1362 lists the data allowing the identification of any person who has contributed to the creation of content posted online, pursuant to II of Article 6 of the Law of June 21, 2004 on confidence in the Internet. SOCIAL NETWORKS

Each User has the possibility of clicking on the icons dedicated to the social networks Twitter, Facebook, Linkedin and Instagram appearing on the Site or in the Justiscall Platform.

Social networks improve the user-friendliness of the Site and help promote it through sharing. The Video Sharing Services make it possible to enrich the Site with video content and increase its visibility.

When the User clicks on these buttons, Justiscall may have access to the personal information that the User has indicated as public and accessible from his Twitter, Facebook, Linkedin and Google plus profiles. However, Justiscall does not create or use any database independent of Twitter, Facebook, Linkedin and Google Plus from the personal information that the User may publish there and Justiscall will not process any Personal Data relating to his private life by this bias.

If the User does not want Justiscall to have access to the personal information published on the public space of his profiles or social accounts, the User must then use the means made available to him by Twitter, Facebook, Linkedin and Google Plus. in order to limit access to his Personal Data.

SECURITY

Each Legal Actor receiving Personal Data in the context of its use of the Services undertakes to guarantee its security and confidentiality.

Justiscall implements all technical and organizational measures to ensure the security of processing and the confidentiality of Personal Data.

As such, Justiscall takes all necessary precautions, with regard to the nature of the Personal Data and the risks presented by the processing, in order to preserve the security of the Personal Data and, in particular, to prevent them from being distorted, damaged, or that unauthorized third parties have access to it (physical protection of the premises, authentication procedures with personal and secure access via confidential identifiers and passwords, logging of connections, encryption of certain Personal Data, end -to-end encryption…).

Justiscall regularly conducts differentiated penetration tests to regularly monitor, evaluate and judge the efficiency of the security measures put in place.

Privacy by Design: Justiscall ensures that data protection and security are taken into account in the planning and development of its Services.

PERSONAL INFORMATION AND MINORS

Use of the Services is reserved for Users who are natural persons over fifteen

(15) years capable of incurring bonds in accordance with applicable law.

POLICY TERMS AND CONDITIONS

Justiscall may modify, complete or update this Policy in order to take into account any legal, regulatory, jurisprudential and/or technical developments.

In the event of a significant change to this Policy (relating to processing purposes, personal data collected, exercise of rights, transfer of users' personal data), Justiscall undertakes to inform users. by any written means within a minimum period of thirty (30) days before their effective date.

In the event of the User's disagreement with the terms of the new Policy, the latter may delete his Justiscall account.

After this period, all access and use of the Services will be subject to the new Policy.

All Users are informed that the only version of the Terms of use (“CU”) and of the Policy which prevails is the one which is online which he acknowledges and accepts without restriction.

The User is required to refer to the version of the TOS and the Policy in force on the date of their access to the Services and each time they are used.
